All State Listings offers you, the "User," services that are conditioned on your acceptance of the terms and conditions contained in this agreement. Your use of All State Listings services constitutes your agreement to all such terms, conditions, and notices.  All State Listings reserves the right to modify in its sole discretion this agreement and or the All State Listings web site without providing notification. You are responsible for regularly reviewing the Agreement.

Please do not visit or use any of the All State Listings web sites or any page that is part of the All State Listings web site if you do not wish to be bound by these terms of use.

All State Listings has taken reasonable and appropriate measures to deliver and disclose your personal information only in accordance with your instructions based on All State Listings Privacy Policy, but cannot and does not guarantee that others will not intercept your personal information you provide. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the All State Listings web site.

You agree to provide true, complete and accurate information on your request form that mortgage or real estate professionals may keep, whether or not you qualified for their loan. You also agree to refrain from impersonating or falsely representing your affiliation with any person or entity.

- All State Listings does not endorse or recommend products of any particular lender , mortgage, or real estate professional.
- All State Listings does not validate or endorse the information contained in the submission of leads initiated through  the web site.
- All State Listings is not an agent of you, the User, or any participating lender, real estate agent, or mortgage professional.
- All State Listings is not responsible for the accuracy or validity of any of the listings posted on the web site.  This is the responsibility of those person(s), real estate agency, or real estate agent(s) who submitted them.
- All State Listings is not responsible for, nor validates the authenticity of the uploading of any company logos, URLs, trademarks, photographs, or other information. You agree that the mortgage, real estate or other professionals are solely responsible for their services to you. Lenders, real estate, and mortgage professionals can offer their products as per the licensing requirements by state.
- All State Listings is a marketing service only. You should decide for yourself which service or product is best for you.  You also agree that All State Listings shall not be liable for any damages or costs of any type arising out of or in any way connected with your use of such products or services.

Indemnity
As a condition of use of this web site, you agree to indemnify All State Listings and its suppliers, affiliates, executives, employees, participating lenders, or other related marketing, mortgage and real estate professionals from any and all liabilities, expenses (including attorneys' fees) and damages arising out of claims resulting from your use of All State Listings ’s services, including without limitation any claims alleging facts that if true would constitute a breach by you of this agreement.

Errors and Delays
All State Listings is not responsible for any errors or delays in responding to a qualification form or referral form caused by an incorrect/invalid e-mail address or any other identifiable information provided by you, or other technical problems beyond our reasonable control.  Any content and/or listing posted on the All State Listings website deemed reliable but not guaranteed. All measurements are approximate.

Dispute Resolution
THIS AGREEMENT PROVIDES THAT ALL DISPUTES BETWEEN YOU AND All State Listings WILL BE RESOLVED BY BINDING ARBITRATION. YOU THUS GIVE UP YOUR RIGHT TO GO TO COURT TO ASSERT OR DEFEND YOUR RIGHTS. YOU ALSO GIVE UP YOUR RIGHT TO PARTICIPATE IN OR BRING CLASS ACTIONS. YOUR RIGHTS WILL BE DETERMINED BY NEUTRAL ARBITRATORS AND NOT A JUDGE OR JURY.

You are entitled to a fair hearing, but the arbitration procedures are simpler and more limited than rules applicable in court. Arbitrator decisions are enforceable as any court order and are subject to very limited review by a court. By using All State Listings ’s goods and services you consent to these restrictions. If either party employs attorneys to enforce any right in connection with any Dispute or lawsuit the prevailing party shall be entitled to recover reasonable attorneys' fees.

Other terms
This Agreement constitutes the entire agreement between you and All State Listings and it supersedes all prior or contemporaneous communications, promises and proposals, whether oral, written or electronic, between you and All State Listings with respect to the web site and information, products and services associated with it. This Agreement shall be subject to and construed in accordance with the laws of the State of Colorado, excluding its conflict of laws principles. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid enforceable provision that most closely matches the intent of the original provision, and the remainder of the agreement shall continue in effect. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
All rights not expressly granted in this User Agreement are hereby reserved.

We believe your privacy is important. At All State Listings , we understand that you provide us with information and we collect and retain information for the following reasons:

- to help you find a mortgage professional or real estate agent/real estate agency who can meet your needs

- to process your requests for products and services
- to inform you about other products and services

All State Listings will not sell or share any personal information about you except as explained in our Privacy Policy. By submitting your form you have authorized us to provide your information to:

- participating mortgage and realty professionals
- other marketing companies whose clients include mortgage and other professionals
- other parties that could potentially help in your transaction or search
- affiliated companies owned in whole or in part by our parent holding company that may be involved with financial service providers, mortgage and life insurance agencies, title service companies, auto finance companies and other industries
- financial institutions who we have joint marketing arrangements

All State Listings is an online marketplace to help consumers pick a mortgage, realty,  and other professionals they believe is best suited for them. There are hundreds of professionals who participate through All State Listings either independently, through their organization or through a client or affiliate of ours.

You may be entering information on the All State Listings site that you consider personal and non-personal. You may choose  to participate in this service and disclose information that you may consider to be personal and non-personal. This service is completely voluntary. Information that you provide on your form may include your contact , mortgage, employment and other required information. All State Listings may supplement the information you provide with information from third party sources. All State Listings may collect and track certain user information, including technical information, to help us evaluate ways to provide the best consumer experience. You may also choose whether to participate in All State Listings surveys or to contact All State Listings through the “Contact Us” feature.

All State Listings provides the information you complete on the form to exclusive realty agents or other professionals relevant to finding a mortgage or real estate professional. All State Listings may also share certain aggregated data with our mortgage professionals, agents, and other third parties for general marketing and demographic purposes; however, this data does not include any personal identifying information. You have directed us to provide your information to exclusive mortgage or real agents or other third parties when you click on the "Submit" button. We recommend that you contact directly real estate or mortgage professionals in order to learn more about their specific privacy policies and terms of use. All State Listings may notify you about a special offer, but does not reveal your identifying information to any outside promotional user unless you request us to do so. All State Listings may email you information, but you will have the ability to opt-out of receiving email if you wish to do so. To opt-out, please email info@AllStateListings.com and put “remove” me in the subject header and your contact information in the body of the email. All State Listings will do its best to protect the loss, misuse and alteration of information under our control.

We believe safeguarding your information is important. Your information is stored in a secure location with restricted access. We have and monitor physical and electronic security measures as well as related procedures.
